PENA – DPD KNPI Maluku Utara (Malut), Selasa (23/6) ikut mengeluarkan statement penolakan terkait Racangan Undang-undang Haluan Ideologi Pancasila (RUU-HIP).
Kepada Penamalut, Wakil Ketua DPD KNPI Malut Hendra Kasim menyatakan, RUU HIP harus ditolak, bukan ditunda.
Hendra punya beberapa alasan terkait pernyataan tersebut. Baginya, Pancasila adalah sumber dari segala sumber hukum. Soekarno menyebutnya filosofis grondslach, sedangkan Hans Kelsen menyebutnya staat fundamental norm, atau source of the source.
Alumni Pascasarjana UII Yogyakarta ini menyatakan, RUU HIP berpotensi menyebabkan konflik antar norma (conflict of norm) atau benturan antar norma (clash between preaviling norm).
Selain itu, RUU HIP juga berpotensi menimbulkan kerancuan dalam pengujian peraturan perundang-undangan, problem stuffen bow theory – Hans Nawiasky.
“Bahayanya lagi, RUU HIP ini menegasi (menyangkal) keberaan TAP MPRS Nomor XXV/MPRS/1966 tentang Pembubaran Partai Komunis Indonesia (PKI),” tegasnya.
Hendra lagi-lagi menegaskan penolakan terhadap RUU HIP. Menurutnya, dalam kajian politik hukum, yang dimaksud tunda adalah akan dibahas dilain waktu.
“Sebab itu, kami mengajak warga dan khususnya pemuda di Malut, untuk bersama menolak RUU HIP,” tegasnya. (*)
