PENAMALUT.COM, TERNATE – Empat terdakwa perkara dugaan tindak pidana korupsi (Tipikor) pengadaan Kapal Nautika dan Alat Simulator menjalani sidang putusan di Pengadilan Negeri (PN) Tipikor Ternate, Rabu (16/2) tadi.
Dalam sidang putusan tersebut, dua terdakwa yakni Imran Yakub selaku mantan Kepala Dinas Pendidikan dan Kebudayaan (Dikbud) Provinsi Maluku Utara dan Reza selaku mantan Ketua Pokja ULP Malut divonis bebas.
Sementara terdakwa Zainudin Hamisi selaku Pejabat Pembuat Komitmen (PPK) pada proyek tersebut dan Ibrahim Ruray selaku rekanan divonis bersalah oleh majelis hakim. Zainudin divonis 8 tahun penjara dan denda sebanyak 300 juta rupiah, sedangkan Ibrahim Ruray divonis 6 tahun penjara dan denda 300 juta rupiah.
Sidang yang dipimpin Ketua Majelis Hakim Achmad Ukayat didampingi dua hakim anggotanya itu dihadiri ke empat terdakwa beserta kuasa hukum mereka.
Dalam putusan yang dibacakan Ketua Majelis Hakim Achmad Ukayat, majelis hakim menolak dakwaan terhadap Imran Yakub dalam memperkaya diri sendiri sesuai dengan tuntutan dan dakwaan primer dari Jaksa Penuntut Umum (JPU) dalam Pasal 2 ayat 1 Undang-Undang Nomor 31 tahun 1999 sebagaiman diubah dengan UU Nomor 20 tahun 2001 tentang Tipikor junto Pasal 55 ayat 1 ke 1 KUHP. Ini setelah melihat fakta hukum pada sidang-sidang sebelumnya.
“Mengadili, menyatakan terdakwa Imran Yakub tidak terbukti secara sah dan meyakinkan melakukan tindak pidana sebagaimana yang didakwa oleh Jaksa Penuntut Umum dalam dakwaan primer maupun subsider. Membebaskan terdakwa dari segala yang menyangkut dakwaan penuntut umum. Memulihkan hak-hak terdakwa dalam kedudukan hak-hak serta martabatnya seperti keadaan semula. Membebaskan terdakwa keluar dari tahanan penjara,” demikian bunyi putusan teraebut.
Begitu juga terdakwa Reza, hakim memutuskan yang bersangkutan tidak bersalah. Sehingga baik Imram maupun Reza dibebaskan dari dakwaan JPU.
Sementara untuk terdakwa Zainudin Hamisi dan Ibrahim Ruray divonis bersalah. Keduanya juga diberi waktu selama satu minggu untuk melakukan pengembalian uang negara. Jika selama satu minggu tidak dikembalikan, maka harta benda yang dimiliki kedua terdakwa akan disita.
Pada kesempatan itu, JPU belum menyatakan tanggapannya atas putusan majelis hakim dan masih pikir-pikir.
Sebelumnya, ke empat terdakwa didakwa bersalah oleh JPU atas atas kasus yang diduga merugikan keuangan negara senilai 4 miliar lebih. Dalam dakwaan JPU, ke empat terdakwa ini dituntut 8 tahun penjara dan 300 juta rupiah. (tr1/ask)
