PENAMALUT.COM, TOBELO – Mantan Kepala Desa Tuguis, Kecamatan Kao Barat, Kabupaten Halmahera Utara, Yordan Hayati, dituntut pidana 5 tahun 6 bulan penjara atas dugaan korupsi anggaran Desa Tuguis tahun 2016-2017.
Yordan dituntut bersalah menyalahgunakan anggaran desa dalam siding lanjutan yang berlangsung di Pengadilan Negeri (PN) Tindak Pidana Korupsi (Tipikor), Selasa (31/5) kemarin.
Jaksa Penuntut Umum (JPU), Andi Ashar Rahmatullah dalam membacakan tuntutan tersebut menyampaikan bahwa terdakwa Yordan Hayati alias Odan didakwa melanggar ketentuan Pasal 2 ayat (1) junto Pasal 18 Undang-Undang Nomor 31 tahun 1999 sebagaimana telah diubah dan ditambah dengan Undang-undang Nomor 20 tahun 2001 tentang Pemberantasan Tindak Pidana Korupsi junto Pasal 55 Ayat (1) Ke-1 KUHP dengan Subsidair Pasal 3 junto Pasal 18 Undang-Undang Nomor 31 tahun 1999 sebagaimana telah diubah dan ditambah dengan Undang-undang Nomor 20 Tahun 2001 tentang Pemberantasan Tindak Pidana Korupsi junto Pasal 55 Ayat (1) Ke-1 KUHP.
” Terdakwa dituntut pidana penjara selama 5 tahun dan 6 bulan, serta pidana denda sebesar Rp 200.000.000 subsidair tiga bulan kurungan dan membayar uang pengganti sebesar Rp 729.218.743,52 subsidair pidana penjara selama 2 tahun dan 9 bulan,” tegas Andi.
Sekadar diketahui, perbuatan terdakwa sebagaimana dalam kasus dugaan korupsi anggaran desa ini mengakibatkan kerugian keuangan negara sebesar Rp 729.218.743,52. (fnc/ask)
