PENAMALUT.COM, JAILOLO – Kantor Desa Borona, Kecamatan Ibu Utara, Kabupaten Halmahera Barat, dipalang warga setempat pada Jumat (10/6) pekan Kemarin.
Pemalangan kantor desa ini buntut dari kebijakan Camat Ibu Utara, Dance Rongo, yang mengantikan perangkat Desa Borona tanpa sepengatahuaan Kepala Desa Borona.
Salah seorang tokoh masyarakat Desa Borona, Jhon Maijanga kepada wartawan Nuansa Media Grup (NMG) mengatakan, aksi pemboikotan dan pemalangan kantor desa itu dilakukan lantaran warga tak puas dengan kebijakan Camat Dance Ronga yang mengganti perangkat desa secara sepihak.
“Pemberhentian perangkat Desa Borona ini secara tiba-tiba, kemudian diangkat perangkat desa yang baru juga tanpa sepengetahuan Kepala Desa,” ujar Jhon, Senin (13/6) tadi.
Menurutnya, tindakan yang dilakukan oleh camat itu dinilai melanggar prosedur yang diatur secara teknis di tingkat desa serta mengesampingkan peraturan perundang-undangan sebagaimana yang terkandung dalam Permendagri Nomor 83 tahun 2015 tentang pemberhentian perangkat desa.
“Pergantian perangkat desa ini dilakukan secara tiba-tiba pada Kamis 9 Juni bertempat di Kantor Kecamatan Ibu Utara yang dilantik langsung Camat Dance Ronga secara tiba-tiba, bahkan SK sebagai legalitas yang seharusnya ditandatangani oleh Kepala Desa Estepanus Bassy tidak ada,” ujarnya.
Jhon bilang, masyarakat tidak menerima hasil pemberhentian dan pelantikan perangkat desa yang baru itu lalu marah dan memalang kantor desa.
“Kami masyarakat meminta Camat Dance Ronga untuk hadir dan berdialog secara tertulis agar mempertanggungjawabkan langkah yang diambil, sehingga persoalan ini tidak berdampak pada kehidupan sosial di Desa borona,” pintanya.
Sementara itu, Anggota Komisi I DPRD Halbar, Tamin Ilan Abanun menyayangkan kebijakan Camat Ibu Utara atas pergantian perangkat desa secara sepihak itu.
Kata Tamin, jika memang betul terjadi pemberhentian perangkat desa oleh Camat Ibu Utara, maka ini sangat bertentangan. Sebab pemberhentian perangkat desa sudah diatur dalam Perda Nomor 8 tahun 2016 tentang perangkat desa sebagaimana pada pasal 36 pasal 1, bahwa kepala desa memberhentikan perangkat desa setelah berkonsultasi dengan camat.
“Jadi yang memberhentikan perangkat desa itu adalah kepala desa, bukan camat. Mengapa camat bisa bertindak sejauh itu,” tanyanya.
Ketua Bapemperda itu meminta camat agar tidak mengambil kebijakan sepihak, sebab negara ini memiliki aturan yang telah diatur berdasarkan peraturan perundang-undangan. Sehingga tidak boleh berbuat selejam itu. Seharusnya rujukan camat dalam hal ini adalah peraturan perundang-undangan, bukan justru ikut semaunya selera camat.
“Pemberhentian perangkat desa ini juga diatur dalam Permendagri 83 tahun 2015. Kalau tidak bisa mengakses Perda Nomor 8 tahaun 2016, silakan buka google lihat Permendagri tersebut. Bukan malah berbuat barbar seperti itu,” kesalnya.
Diakatakan Tamin, apapun kondisinya, Camat tidak bisa melakukan pemberhentian kepada perangkat desa, karena itu adalah kewenangan kepala Desa. Dalam Perda Nomor 8 tahun 2016 pada ayat 3 sudah diatur jelas bahwa pemberhtian perangkat desa ditetapkan oleh kepala desa, kemudian disampaikan kepada camat paling lambat 14 hari setelah ditetapkan.
Ia juga menegaskan dalam waktu dekat pihaknya akan melakukan kunjungan kerja ke Desa Borona untuk mencari tahu permasalahan yang sesungguhnya terjadi. Sebab kebijakan pemberhentian perangkat desa yang dilakukan oleh camat tidak bisa dibenarjan.
“Dalam waktu dekat kita akan melakukan kunjungan kerja ke Desa Borona untuk bisa mengetahui permasalahan yang sesungguhnya terjadi,” pungkasnya. (uum/ask)
