PENAMALUT.COM, TERNATE – Majelis hakim Pengadilan Tindak Pidana Korupsi (Tipikor) pada Pengadilan Negeri Ternate memerintahkan kepada Jaksa Penuntut Umum (JPU) untuk menghadirkan Hendrata Thes selaku mantan Bupati Kepulauan Sula (Kepsul) ke persidangan.
Mantan Bupati Sula periode 2016-2021 ini diperintahkan majelis hakim untuk hadir dalam sidang dengan perkara Nomor 26/ Pid.Sus-TPK/2022/PN Tte atas nama terdakwa Ir. Salim Haris AR alias Salim, dan Nomor 27/ Pid.Sus-TPK/2022/PN Tte atas, Abraham Pranotoadi alias Bram.
Majelis hakim diketahui sebelumnya telah mengeluarkan perintah kepada JPU untuk menghadirkan Hendrata dalam persidangan yang sudah digelar beberapa kali kemarin. Sayangnya, mantan Ketua DPD Partai Demokrat Maluku Utara itu tak patuh.
Juru bicara PN Ternate, Kadar Noh, mengaku bahwa Pengadilan telah mengeluarkan surat penetapan panggilan paksa tersebut.
“Menyangkut dengan pemanggilan paksa terhadap mantan Bupati Kepulauan Sula (Hendrata) itu betul,” akunya kepada wartawan Nuanasa Media Grup (NMG), Selasa (18/10) kemarin.
Menurut dia, surat penetapan itu dengan Nomor:26/Pid.Sus-TPK/2022/PN Tte, bahwa pada persidangan tanggal 22 September 2022, saksi Ferdi Parengkuan alias Ferdi dalam keterangannya telah memberikan fee atas permintaan Hendrata Thes untuk kegiatan proyek pekerjaan pembangunan Bendungan dan Jaringan lrigasi Kaporo pada Dinas Pekerjaan Umum Penataan Ruang Perumahan dan Kawasan Pemukiman (PUPRKP) Kabupaten Kepulauan Sula tahun 2018 dan 2019 sebesar Rp 2.450.000.000.
“Berdasarkan Pasal 160 ayat (1) huruf c, penuntut menyatakan akan menghadirkan Hendrata Thes sebagai saksi dalam perkara ini. Sehingga majelis hakim memerintahkan kepada penuntut umum untuk memanggil Hendrata Theis,” terangnya.
Ia bilang, walaupun telah dipanggil secara sah berdasarkan surat panggilan Nomor: B-424/Q.2.14/ Ft.1/09/2022 tanggal 28 September 2022 dan surat panggilan Nomor: B-465/Q.2.14/Ft.1/10/2022 tanggal 3 Oktober 2022, mamun Hendrata Theis tidak hadir di persidangan tanggal 6 Oktober 2022 dan 13 Oktober 2022 tanpa alasan yang sah.
“Oleh karena itu, tidak ada jawaban mengenai kepastian kehadiran Hendrata Thes, maka majelis hakim memiliki alasan bahwa Hendrata Thes tidak akan mau hadir,” tuturnya.
Oleh karena kedudukan dan peran Hendrata Thes sangat penting untuk kepentingan pembelaan terdakwa maupun untuk mencapai kebenaran materiil dalam perkara ini, maka berdasarkan Pasal 159 ayat (2) Kitab Undang-Undang Hukum Acara Pidana (KUHAP) perlu memerintahkan agar Hendrata Thes dihadapkan ke persidangan.
Mengingat ketentuan Pasal 159 ayat (2) KUHAP serta peraturan-peraturan lain yang berkaitan. Atas dasar itu, majelis mengeluarkan surat memerintahkan kepada penuntut umum untuk menghadapkan Hendrata Thes ke persidangan Pengadilan Negeri Ternate dalam perkara Nomor 26/ Pid.SusTPK/2022/PN Tte atas nama terdakwa Salim dan nomor 27/ Pid.Sus-TPK/2022/PN Tte terdakwa Abraham pada Kamis tanggal 20 Oktober 2022 nanti.
“Memerintahkan agar penuntut umum dan terdakwa atau penasehat hukumnya selekas mungkin diberikan sehelai tembusan dari penetapan ini,” pungkasnya. (gon/ask)
