PENAMALUT.COM, SANANA – Majelis hakim Pengadilan Negeri (PN) Sanana menolak seluruh gugatan Andreas Ham terkait ganti rugi anggaran material pembangunan reklamasi di Kota Sanana senilai Rp 3 miliar.
Sidang putusan tersebut dipimpin langsung Ketua Pengadilan Negeri, Djoko Wiryono Budhi Sarwoko yang dihadiri pihak tergugat yakni Kepala Bagian Hukum Setda Kepulauan Sula, Mardia Umasangadji. Sementara pihak penggugat dihadiri kuasa hukum Andreas Ham, Adha Buamona.
Kepala Bagian Hukum Setda Kepulauan Sula, Mardia Umasangadji mengatakan, setelah mengikuti sidang putusan Selasa (20/9) tadi, majelis hakim menolak seluruh gugatan dari penggugat. Di mana dalam pembacaan amar putusan, penggugat ternyata hanya membuat kesepakatan secara lisan dengan saudara Rusman Buamona yang pada saat itu selaku Pejabat Pelaksana Teknis Kegiatan (PPTK) dari Dinas PUPR yang bukan pengambil kebijakan.
“Seharusnya sebagai penggugat pada saat itu tidak harus mengikuti arahan dari saudara Rusman Buamona, kerena dia bukan sebagai pengambil kebijakan,” ucap Mardia kepada wartawan.
“Dengan putusan tadi, maka Pemda Kepulauan Sula menang dalam perkara perdata ini,” sambungnya.
Sekadar diketahui, Pemda Kepulauan Sula digugat ke pengadilan lantaran belum membayar biaya material timbunan senilai Rp 3 miliar. Gugatan ini dilayangkan Andreas Ham di PN Sanan pada 12 April 2022. Di mana, pihak tergugat dalam hal ini Pemda Kepsul belum membayar kerugian materiil maupun immaterial kepada penggugat selama 8 tahun, terhitung sejak 2015 hingga 2022. (ish/ask)
