PENA – Hakim tunggal Pengadilan Negeri (PN) Ternate, memutuskan gugatan praperadilan yang diajukan oleh Direktur PT Tamanlarea Karsatama berinisial IR disahkan, Senin (5/4) hari ini.
Hal itu berarti, penetapan tersangka IR dalam dugaan korupsi pengadaan kapal nautika dan alat simulator pada Dinas Pendidikan dan Kebudayaan Malut, tidak sah.
Pada praperadilan tadi, surat penetapan tersangka yang dikeluarkan Kejaksaan Tinggi Malut dengan nomor: Print-69/02/Fd.1/02/2021 tertanggal 10 Februari 2021, diputuskan tidak sah.
Hakim PN Ternate memutuskan, menolak eksepsi termohon atau Kejati Malut untuk seluruhnya. Maka pokok perkara yang diputuskan tidak sah adalah penetapan termohon kepada pemohon sebagai tersangka.
Hakim juga memberi perintah kepada termohon untuk patuh pada keputusan pengadilan dan seluruh biaya yang berjumlah nihil juga dibebankan kepada termohon. (*)
