PENAMALUT.COM, TERNATE – Sidang lanjutan perkara gugatan perbuatan melawan hukum (PMH) dan ganti rugi dengan tergugat Rektor Universitas Muhammadiyah Maluku Utara (UMMU), Prof. Saiful Deni dan Dekan Fakultas Hukum, Rahim Yasin, kembali digelar di Pengadilan Negeri Kota Ternate, Kamis (28/10).
Sidang dengan agenda penentuan mediasi ini dipimpin Ketua Majelis Hakim, Kadar Noh, didampingi dua hakim anggotanya Khadijah A. Rumalean dan Ulfa Rery. Sidang kali ini dihadiri kuasa hukum penggugat, tergugat dan kuasa hukumnya.
Muhammad Thabrani selaku kuasa hukum Rani Andini Yasa kepada wartawan menuturkan, ini merupakan sidang ketiga penentuan mediasi perkara Rani Andini Yasa sebagai penggugat melawan Rektor dan Dekan Fakultas Hukum UMMU selaku tergugat.
Sidang pekan depan akan dipanggil kedua belah pihak untuk hadir dalam mediasi. Namun penggugat tetap pada gugatan yang diajukan.
“Nanti hasil mediasi seperti apa, namun kami tetap pada gugatan,” tegasnya.
Terpisah, Dekan Fakultas Hukum UMMU, Rahim Yasin menganggap gugatan dari penggugat itu biasa-biasa saja. Ia memastikan dalam waktu dekat apa yang menjadi hak penggugat (Rani) akan diberikan.
“Ini soal waktu, apalagi pidana dan perdata saat ini berjalan. Insyah Allah saya kordinasikan dulu dengan pimpinan dalam hal ini Rektor dan pimpinan wilayah kapan dan akan ditentukan dalam rapat. Tapi kami dari pihak kampus akan berikan ijazah karena hak dia,” janjinya.
Ia menambahkan, gugatan yang diajukan oleh penggugat akan dijawab seluruhnya melalui mediasi maupun gugatan di persidangan.
“Kami akan layani dengan baik,” ujarnya.
Sekadar diketahui, perkara Nomor 63/Pdt.G/2021/PN Tte yang diajukan mantan mahasiswanya Rani Andini Yasa. Gugatan PMH dan ganti rugi ini dikarenakan pihak kampus UMMU tidak mau menandatangani dan menyerahkan Ijazah dan transkip akademik milik penggugat.
Padahal secara adminitrasi penggugat yang telah memenuhi persyaratan kelulusan dan administratif, bahkan sudah melewati prosesi wisuda dan berhak mendapatkan ijazah maupun transkrip nilai. Perbuatan tergugat yang menahan dan tidak mau menandatangani Ijazah dan transkip nilai penggugat merupakan tindakan yang melanggar pasal 25 ayat (1) junto pasal 61 ayat (2) Undang-Undang Nomor 20 tahun 2003 tentang Sistem Pendidikan Nasional.
Selain itu, tindakan tergugat (Rektor dan Dekan) juga dengan sengaja melanggar pasal 26 ayat (1) dan (2) huruf a junto pasal 42 ayat (1) dan (2) UU Nomor 12 tahun 2012 tentang Pendidikan tinggi junto pasal 5 ayat (1), pasal 11 ayat (1) huruf a, pasal 11 ayat (2), pasal 21 ayat (1) Peraturan Menteri Riset, Teknologi, dan Pendidikan Tinggi Republik Indonesia Nomor: 59 tahun 2018 tentang Ijazah, Sertifikat Kompetensi, Sertifikat Profesi, Gelar dan Tata Cara Penulisan Gelar di Perguruan Tinggi (Permenristekdikti Nomor 59 tahun 2018).
Ketentuan-ketenuan tersebut mengatur bahwa gelar akademik sarjana diberikan oleh perguruan tinggi yang menyelenggarakan pendidikan akademik dalam hal ini UMMU. Adapun ijazah diberikan kepada lulusan pendidikan akademik sebagai pengakuan terhadap penyelesaian suatu program studi terakreditasi yang diselenggarakan oleh perguruan tinggi (UMMU). (gon/ask)
