PENAMALUT.COM, TERNATE – Abdul Hamid Rahim alias Hamid, terdakwa dugaan korupsi penyalahgunaan premi asuransi nasabah pada PT. Asuransi Jiwasraya (Persero) area Ternate tahun 2017-2020 menjalani sidang tuntutan di Pengadilan Tindak Pidana Korupsi (Tipikor) pada Pengadilan Negeri Ternate.
Sidang yang dipimpin Ketua Majelis Hakim, Khadijah Amalzain Rumalean didampingi Budi Setiawan dan Samhadi selaku hakim anggota.
Jaksa Penuntut Umum (JPU) Kejaksaan Negeri Ternate, Fajar Hidayat, dalam membacakan tuntutannya menyampaikan bahwa berdasarkan uraian-uraian yang telah dibacakan, maka seluruh unsur-unsur terhadap dakwaan primair Pasal 2 ayat (1) junto Pasal 18 Undang-Undang Nomor 31 tahun 1999 sebagaimana telah diubah dengan UU Nomor 20 tahun 2001 tentang perubahan atas UU Nomor 31 tahun 1999 tentang pemberantasan tindak pidana korupsi telah terpenuhi.
“Oleh karena itu, terdakwa haruslah dijatuhi hukuman yang setimpal dengan perbuatannya,” ujarnya.
Dengan terpenuhi seluruh unsur-unsur dakwaan primair, lanjut dia, maka terdakwa telah terbukti secara sah dan meyakinkan menurut hukum bersalah melakukan tindak pidana korupsi sebagaimana yang didakwakan.
Oleh karena itu, Fajar menyatakan terdakwa Abdul Hamid Rahim alias Hamid terbukti secara sah dan meyakinkan bersalah melakukan tindak pidana korupsi sebagaimana dalam dakwaan primair.
“Menjatuhkan pidana kepada terdakwa Abdul Hamid oleh karena itu dengan pidana penjara selama 5 tahun, serta membayar denda sebesar Rp200 juta dengan ketentuan, apabila denda tersebut tidak dibayar diganti dengan pidana kurungan selama tiga bulan. Namun pidana yang dituntut kepada diri terdakwa dikurangi seluruhnya selama terdakwa berada dalam tahanan,” jelasnya.
Selain itu, JPU juga menuntut pidana tambahan berupa hukuman untuk membayar uang pengganti sebesar Rp 131.562.526, dan apabila dalam waktu satu bulan sesudah putusan pengadilan memperoleh kekuatan hukum tetap terdakwa tidak membayar uang pengganti, maka harta bendanya dapat disita dan dilelang untuk menutupi uang pengganti tersebut.
“Dalam hal terdakwa tidak mempunyai harta benda yang mencukupi untuk membayar uang pengganti, maka dipidana dengan pidana penjara selama 6 bulan,” ucapnya.
Atas perbuatannya, terdakwa diancam pidana dalam Pasal 2 ayat (1) junto Pasal 18 ayat (1) UU Nomor 31 tahun 1999 tentang pemberantasan tindak pidana korupsi sebagaimana telah diubah dengan UU Nomor 20 tahun 2001 tentang perubahan atas UU Nomor 31 tahun 1999 tentang pemberantasan tindak pidana korupsi.
Terpisah, terdakwa Abdul Hamid Rahim melalui kuasa hukumnya,
M. Jais Umar mengatakan, pihaknya akan mengajukan pledoi/pembelaan pada sidang lanjutan pekan depan secara tertulis.
Menurut Jais, kerugian negara hanya 100 juta sekian, namun tuntutan ini berbeda dengan perkara korupsi yang lain. Perkara korupsi kerugian negaranya diatas 500 juta, tapi yang dituntut menggunakan pasal 3 dengan ancaman hukum paling singkat 1 tahun.
“Kami dari penasehat hukum terdakwa beranggapan bahwa JPU masih keliru dalam menerapkan pasal. Kami akan mengajukan pembelaan berdasarkan dengan analisis fakta-fakta yang terungkap dalam persidangan. Kami juga meminta kepada majelis hakim agar bisa memutuskan dengan pasal 3,” tandasnya.
Sekadar diketahui, berdasarkan data yang dihimpun wartawan Nuansa Media Grup (NMG), hasil audit perhitungan kerugian keuangan negara dari BPKP Perwakilan Malut pada kasus tersebut senilai Rp 131.562.526. Dugaan kasus korupsi penyalahgunaan Premi Asuransi Nasabah (bulanan, Semester dan Tahunan) pada PT. Asuransi Jiwasraya (Persero) Area Ternate untuk pembayaran angsuran pada periode Maret 2017 sampai Juli 2020.
Dalam kasus ini, penyidik melakukan penyelidikan ejak 19 Oktober 2020 lalu. Kemudian kasus tersebut penyidik tingkatkan ke tahap penyidikan pada 31 Januari 2022 kemarin. (gon/ask)
