Tiga Terdakwa Kasus Korupsi Dana Hibah Panwaslu Halut Dihukum Ringan

PENAMALUT.COM, TERNATE – Tiga terdakwa perkara korupsi dana hibah Penwaslu Kabupaten Halmahera Utara tahun 2015-2016 menjalani sidang pembacaan putusan yang berlangsung di Pengadilan Tipikor Negeri Ternate, Selasa (28/6) sore tadi.

Ketiga terdakwa itu divonis lebih ringan dari tuntutan Jaksa Penuntut Umum (JPU).

Pada kesempatan itu, terdakwa SD alias Silvano Diaz Hangewa selaku 
mantan Sekretaris Panwaslu sekaligus PPK (Pejabat Pembuat Komitmen) lebih dulu dihadirkan sidang putusan tersebut.

Ketua Majelis Hakim, Iwan Anggoro Warsita dalam membacakan amar putusan menyatakan, terdakwa Silvano Diaz Hangewa tidak terbukti secara sah dan meyakinkan melakukan tindak pidana korupsi sebagaimana dalam dakwaan primair penuntut umum. Membebaskan terdakwa Silvano dari dakwaan primair penuntut umum.

Merdakwa Silvano terbukti secara sah dan meyakinkan bersalah melakukan tindak pidana korupsi sebagaimana dalam dakwaan subsidair.

“Menjatuhkan pidana kepada terdakwa Silvano oleh karena itu dengan pidana penjara selama 2 tahun dan pidana denda sebesar Rp 50 juta, dengan ketentuan apabila tidak dibayar diganti dengan pidana kurungan selama 2 bulan,” ucap majelis hakim.

Terdakwa Silvano juga dijatuhi pidana tambahan berupa membayar uang pengganti sebesar Rp 740 juta. Apabila dalam waktu satu bulan sesudah putusan pengadilan memperoleh kekuatan hukum tetap terdakwa tidak membayar uang pengganti, maka harta bendanya dapat disita dan dilelang untuk menutupi uang pengganti tersebut.

Dalam hal terdakwa tidak mempunyai harta benda yang mencukupi untuk membayar uang pengganti, maka dipidana dengan pidana penjara selama satu tahun dan 5 bulan.

Selanjutnya terdakwa Gustiar Marudin selaku mantan bendahara pengeluaran Panwaslu Halut, dinyatakan terbukti secara sah melakukan tindak pidana korupsi dalam dakwaan subsider sebagaimana dakwaan penuntut umum. Oleh karena itu, menjatuhkan pidana penjara kepada terdakwa Gustiar selama 1 tahun 5 bulan dan denda Rp 50 juta subsider 2 bulan kurungan.

“Menjatuhkan pidana tambahan kepada terdakwa Gustiar membayar uang pengganti sebesar Rp 399 juta, dengan ketentuan apabila terpidana tidak membayar uang pengganti tersebut selama satu bulan sesudah putusan berkekuatan hukum tetap, maka harta bendanya akan disita oleh Jaksa untuk dilelang menutupi uang pangganti,” jelas hakim.

Dalam hal terdakwa mempunyai harta yang cukup untuk membayar uang pengganti, maka dipidana penjara selama satu tahun.

Sementara terdakwa Muksin Bonga selaku mantan Ketua Panwaslu Halut dijatuhi pidana penjara selama 2 tahun dan denda Rp 50 juta. Jika denda tersebut tidak dibayar, maka diganti dengan pidana kurungan selama 2 bulan.

“Menjatuhkan pidana untuk membayar uang pengganti Rp 90 juta. Apabila dalam waktu satu bulan sesudah putusan pengadilan memperoleh kekuatan hukum tetap terdakwa tidak membayar uang pengganti, maka harta bendanya dapat disita dan dilelang untuk menutupi uang pengganti tersebut,” kata majelis hakim.

Jika dalam hal ini terdakwa tidak mempunyai harta benda yang mencukupi untuk membayar uang pengganti, maka dipidana dengan pidana penjara selama 1 tahun.

Menetapkan masa penahanan dikurangkan seluruhnya dari pidana yang dijatuhkan dan memerintahkan terdakwa tetap ditahan dalam tahanan.

Para terdakwa melanggar ketentuan pasal 3 ayat (1) junto pasal 18 Undang-Undang Nomor 31 tahun 1999 sebagaimana telah diubah dan ditambah dengan UU Nomor 20 tahun 2001 tentang pemberantasan tindak pidana korupsi junto pasal 55 ayat (1) ke-1 KUHP dengan subsidair pasal 3 junto pasal 18 UU Nomor 31 tahun 1999 sebagaimana telah diubah dan ditambah dengan UU Nomor 20 tahun 2001 tentang pemberantasan tindak pidana korupsi junto pasal 55 ayat (1) ke-1 KUHP serta ketentuan perundang- undangan lain.

Menanggapu putusan tersebut, kuasa hukum terdakwa maupun JPU masih pikir-pikir.

Sebelumnya, terdakwa Muksin Bonga selaku mantan Ketua Panwaslu dituntut JPU dengan pidana penjara selama 4 tahun dan 6 bulan, dengan pidana denda sebesar Rp 200 juta subsidair 3 bulan kurungan.

Terdakwa Muksin Bonga juga dituntut dengan pidana tambahan beruapa membayar uang pengganti sebesar Rp 90 juta. Apabila dalam waktu satu bulan sesudah putusan pengadilan memperoleh kekuatan hukum tetap terdakwa tidak membayar uang pengganti, maka harta bendanya dapat disita dan dilelang untuk menutupi uang pengganti tersebut.

Jika dalam hal ini terdakwa tidak mempunyai harta benda yang mencukupi untuk membayar uang pengganti, maka dipidana dengan pidana penjara selama 2 tahun dan 3  bulan.

Untuk terdakwa SD alias Silvano Diaz Hangewa dituntut pidana penjara selama 5  tahun dan 6 bulan, dengan pidana denda sebesar Rp 200 juta subsidair 3 bulan kurungan.

Terdakwa Silvano juga dituntut pidana tambahan berupa membayar uang pengganti sebesar Rp 740 juta subsidair pidana penjara selama 2 tahun dan 9 bulan.

Sementara terdakwa Gustiar Marudin dituntut pidana penjara selama 5 tahun dengan pidana denda sebesar Rp 200 juta subsidair 3 bulan kurungan.

Terdakwa Gustinar juga dituntut membayar uang pengganti sebesar Rp 339.836.596 subsidair pidana penjara selama 2 tahun dan 6  bulan.

Sekadar diketahui, penyalahgunaan dana hibah Panwaslu Kabupaten Halmahera Utara tahun anggaran 2015-2016 mengakibatkan kerugian keuangan negara sebesar Rp 1.365.861.596. (gon/ask)
