PENAMALUT.COM, TERNATE ā Dugaan permainan tender paket di Pemerintah Provinsi Maluku Utara mulai terbongkar. Ini setelah Badan Pemriksaan Keuangan (BPK) menemukan adanya indikasi pengaturan pemenang tender yang dilakukan oleh Biro Pengadaan Barang dan Jasa (BPJB).
Dalam laporan hasil pemeriksaan (LHP) BPK Perwakilan Malut, terdapat sejumlah paket yang sengaja dimenangkan oleh pihak BPBJ, seperti tender paket pekerjaan Masjid Raya Sofifi senilai Rp 47,9 miliar. Proyek tersebut seharusnya dimenangkan oleh PT. Anggaza Widya Ridhamulia (AWR) yang telah memenuhi semua persyaratan, namun Pokja I yang menangani proyek Masji Raya justru memenangkan PT. Anugerah Lahan Baru (ALB). Padahal ALB tidak memenuhi syarat sebagaimana yang dipersyaratkan.
Tender paket fisik pekerjaan penyediaan sarana dan prasarana persampahan senilai Rp 6,5 miliar. Di mana hasil pemeriksaan seluruh dokumen perencanaan pengadaan, HPS, dokumen penawaran, dan proses evaluasi oleh Pokja UKPB menunjukkan adanya indikasi kuat pengaturan dalam tender paket tersebut.
Tender paket pekerjaan gedung kantor DP3A tahap II senilai Rp 4,7 miliar. Proyek tersebut pada proses tender diikuti 21 peserta, dan terindikasi pengaturan dalam proses pengadaan.
Tender paket pekerjaan pengembangan ruang VVIP Bandara Sultan Baabullah Ternate senilai Rp 4,7 miliar. Proyek tersebut diikuti tiga peserta dalam proses tender. Setelah dilakukan analisa dokumen penawaran milik ketiga perusahaan dan evaluasi teknis yang dilakukan pihak Pokja, menunjukkan adanya indikasi pengaturan dalam proses tender yang dimenangkan oleh CV. MJI.
Praktisi hukum Hendra Kasim menilai dugaan permainan tender proyek sebagaimana temuan BPK ini menjadi bukti yang cukup agar diusut penegak hukum.
Menurut dosen Fakultas Hukum Univeristas Muhammadiyah Maluku Utara (UMMU) ini, ada tiga unsur yang dapat dikategorikan sebagai tindak pidana korupsi. Pertama, menyalahgunakan kewenangan. Kedua, memberikan keuntungan baik kepada diri sendiri maupun orang lain. Ketiga, pekerjaan menimbulkan kerugian keuangan Negara.
āBerdasarkan tmuan BPK ini, kami mecatat setidaknya ada dugaan praktik suap. Sebab adanya penyalahgunaan kewenangan. Sehingga penegak hukum harus mengusut ini,ā tandasnya. (ask)
