PENAMALUT.COM, SOFIFI – Sejumlah kepala daerah di kabupaten/kota di Maluku Utara yang baru dilantik beberapa waktu lalu diketahui telah melakukan pergantian jabatan baik eselon II maupun eselon III.
Pergantian jabatan tersebut diketahui tidak sesuai prosedur lantaran tidak diketahui Gubernur Maluku Utara dan belum mengantongi izin dari Menteri Dalam Negeri (Mendagri).
Padahal, dalam ketentuan yang telah diatur dalam Undang-Undang Nomor 5 tahun 2014 tentang aparatur sipil negara telah diatur secara jelas terkait mekanisme pergantian jabatan tersebut.
Salah satu kepala daerah yang diduga melakukan pergantian jabatan tanpa prosedur itu adalah Bupati Kepulauan Sula, Fifian Adeningsih Mus. Bahkan tim investigasi yang dibentuk Pemprov Malut sudah turun ke Kepulauan Sula untuk mengkaji dan menyelidiki pelantikan pejabat tersebut.
Pejabat yang dilantik tanpa prosedur ini tentu berisiko hukum ketika menggunakan anggaran dari instansi yang dipimpinnya itu.
“Pertimbangan dari tim investigasi dan Inspektorat, ada konsekuensi hukum ketika dia menggunakan anggaran. Kenapa, karena dia diangkat tidak sesuai prosedur,” jelas Kepala Badan Kepegawaian Daerah (BKD) Provinsi Maluku Utara, Idrus Assagaf, kepada wartawan, Senin (12/7).
Idrus mencontohkan pejabat yang diangkat tidak sesuai prosedur itu misalkan yang bersangkutan merupakan pegawai di kabupaten/kota lain yang diangkat jadi pejabat di lain tempat tanpa melalui prosedur pindah tugas atau mutasi.
“Bahkan rekomendasi juga kita sudah sampaikan ke BPK terkait masalah ini,” tegas Idrus.
Selain berkonsekunsi hukum, pegawai tersebut apabila tidak segera mengurus pindah tugasnya, maka pangkat kepegawaiannya tidak bisa naik.
“Karena data di BKN, yang bersangkutan tidak terdaftar sebagai pegawai yang ada di kabupaten/kota yang dilantik saat ini. Itu konsekunsinya bagi pegawai yang tidak mematuhi mekanisme,” pungkas mantan Pj Wali Kota Ternate itu. (ask)
