PENAMALUT.COM, TERNATE – Pihak PT Anugerah Fasad Sejati (AFS) yang merupakan pemilik Pertashop Jambula menanggapi aksi unjuk rasa yang dilakukan Aliansi Suara Rakyat Kota Ternate (ASRKT) pada Kamis, 9 September lalu di depan kantor Wali Kota Ternate.
Kuasa Hukum PT AFS, M Gumar mengatakan, pengelola Pertashop Jambula akan menempuh jalur hukum terhadap salah satu oknum pengunjuk rasa dalam aksi tersebut, yang dalam orasinya menyebutkan bahwa pihak Pertashop melakukan pemalsuan tanda tangan dalam surat persetujuan dengan warga.
“Kami memahami bahwa negara menjamin setiap warga negara mempunyai hak menyampaikan pendapat. Namun, pernyataan yang menyebutkan PT AFS melakukan pemalsuan tanda tangan merupakan tindakan fitnah dan pencemaran nama baik,” tegasnya, Minggu (12/9) di Café A2W Ternate.
Menurut Gumar, Pertashop Jambula telah sejumlah izin sehingga layak untuk beroperasi. Izin tersebut antara lain izin operasional usaha, izin kelayakan, serta izin mendirikan bangunan (IMB) sesuai dengan peruntukkan kawasan.
“Pernyataan oknum pengunjuk rasa itu bahkan diberitakan di sejumlah media massa secara jelas dan transparan. Padahal PT AFS dalam persiapan pengelolaan Pertashop Jambula telah memenuhi syarat-syarat formal sesuai dengan aturan perundang-undangan,” jelasnya.
Gumar menambahkan, dalam proses pengurusan izin dan rencana pembangunan infrastruktur Pertashop, PT Pertamina bersama PT AFS telah melakukan komunikasi dan sosialisasi dengan unsur Pemerintah Kelurahan Jambula dan masyarakat di sekitar lokasi di RT 08/RW 04. Untuk Sosialisasi dilakukan di Meeting Room Kantor Pertamina Jambula.
“Jadi sosialisasi juga diikuti oleh warga sekitar, termasuk 8 warga yang mengeluh di Kantor DPRD Kota Ternate sebelumnya,” tambah Gumar.
Dirinya juga membantah terkait pemberitaan di sejumlah media bahwa warga tidak pernah terlibat dalam sosialisasi. Bagi dia, itu merupakan pernyataan yang menyudutkan karena warga tersebut pernah mengikuti rapat untuk sosialisasi, baik dalam rapat di Kantor Lurah Jambula maupun rapat di Kantor Pertamina Jambula.
Pihak PT AFS, sambung Gumar, dalam sosialisasi kepada warga di RT 08/RW 04 Kelurahan Jambula tersebut juga menjelaskan keberadaan Pertashop dan sistem keamanan terhadap lingkungan.
“Dan faktanya, para warga bisa memahami dan menandatangani surat tidak keberatan pendirian Pertashop. Jadi jika ada oknum yang mengaku tanda tangannya dipalsukan, adanya intimidasi dan sebagainya, maka diperlukan pembuktian secara hukum,” jelasnya.
Kehadiran Pertashop ini, jelas Gumar, merupakan program nasional yang pengopreasiannya sudah melalui persyaratan. Operasionalnya juga dilakukan dengan berbagai pertimbangan, termasuk keamanan warga. Hal ini berbeda dengan depot-depot penjualan BBM dan penyimpanan BBM secara tidak resmi yang ada di Kota Ternate tanpa sistem keamanan.
Selain itu, Gumar juga menyatakan, PT AFS merupakan perusahaan resmi yang mempunyai hak menjalankan bisnis secara legal dalam fungsi pelayanan kebutuhan masyarakat terhadap BBM dan juga membutuhkan perlindungan hukum dari negara. Karena itu, apabila ada oknum-oknum yang sengaja menghambat jalannya roda perekonomian tersebut, pihaknya tentu akan menempuh jalur hukum. (udi)
