PENAMALUT.COM, TERNATE – Pengajuan penangguhan penahanan oleh 3 terdakwa perkara dugaan korupsi pengadaan Kapal Nautika dan alat simulator pada Dinas Pendidikan dan Kebudayaan (Dikbud) Provinsi Maluku Utara ditanggapi praktisi hukum.
Sekretaris DPD Kongres Advokat Indonesia (KAI) Malut, Roslan, meminta hakim pada Pengadilan Negeri Kota Ternate untuk mempertimbangkan secara bijak dan adil terkait pengajuan penangguhan penahanan 3 terdakwa.
Dikatakan Roslan, permohonan penangguhan penahanan yang dimohonkan oleh 3 orang terdakwa itu merupakan hal yang lumrah dan biasa dalam setiap tingkatan proses hukum, bahkan dimungkinkan oleh Kitab Undang-Undang Hukum Acara Pidana (KUHAP).
“Akan tetapi, semua keputusan dikabulkan atau tidaknya permohonan tersebut menjadi domain atau kewenangan majelis hakim yang memeriksa dan mengadili perkara ini,” ujarnya kepada wartawan, Minggu (10/10).
Maka dari itu, ia berharap kepada majelis hakim pemeriksa perkara ini agar dapat mempertimbangkan secara keseluruhan syarat penanguhan yang dimohonkan. Jika tidak memunuhi syarat penangguhan penahanan, maka akan menjadi berbanding terbalik dengan penanganan kasus pidana umum lain yang tidak ada kerugian keuangan negara.
“Ini penting untuk dipertimbabgkan agar tidak menimbulkan asumsi bahwa terhadap terdakwa kasus Tipikor akan mendapat perlakuan khusus. Untuk mencegah asumsi publik itu terjadi, majelis pemeriksa harus pertimbangkan dengan baik dan bijak,” harapnya.
Roslan menambahkan, terlepas dari penanguhan penahanan ini dimungkin oleh KUHAP dengan segala persyaratan dan jaminan yang ditetapkan, secara umum
penanguhan penahanan terdakwa kasus Tipikor akan bertentangan dengan tujuan preventif dan korektif serta tidak mencerminkan upaya edukatif bagi masyarakat luas.
“Kami berharap kasus ini secara hukum harus diterapkan berimbang termasuk dalam hal pengembalian kerugian keuangan negara sebagaimana dengan kasus-kasus Tipikor yang lain. Jika para terdakwa tidak sakit parah yang mengharuskan untuk dirawat inap di rumah sakit, maka sebagai bentuk kesetaraan kami berharap agar ditetapkan sebagai tahanan dalam/Rutan seperti terdakwa lainnya,” harapnya lagi.
Sekadar diketahui, 3 dari 4 terdakwa kasus Nautika yang mengajukan penangguhan penahanan ini yakni Zaenudin Hamisi, Reza, dan Imran Yakub. Sementara Ibrahim Ruray tidak mengajuian penangguhan penahanan.
Ke 4 terdakwa ini pada Senin (5/10) lalu telah menjalani sidang perdana di PN Ternate. (gon/ask)
