PENA – Penghentian penyelidikan kasus dugaan ijazah palsu yang diduga melibatkan calon bupati Halmahera Selatan Usman Sidik, menuai protes dari akademisi Universitas Khairun (Unkhair) Abdul Kadir Bubu.
Kadir mengatakan, jika kasus dugaan ijazah palsu dihentikan sementara sesuai dengan edaran Kapolri, tentu tidak menjadi masalah bagi penyidik. Namun, jika kasus tersebut tiba-tiba dihentikan dengan alasan tidak cukup bukti maka menjadi masalah bagi penyidik, karena melanggar intsruksi Kapolri Jendral Pol Idham Azis, terkait kasus-kasus yang melibatkan calon kepala daerah.
Selain itu, penyidik Polda tidak memiliki alasan kuat untuk menghentikan kasus itu, karena terlapor sendiri sampai sekarang belum dimintai keterangan. Bahkan, hingga sekarang belum ada laporan terkait perkembangan hasil penyelidikan yang harus disampaikan oleh penyidik kepada pelapor.
“Jika tiba-tiba ada penyampaian penghentian penyelidikan oleh Kabid Humas Polda Malut, AKBP Adip Rodjikan, hal itu merupakan sesuatu yang aneh dan ajaib,” tandas Dade, sapaan akrab Abdul Kadir Bubu, Rabu (18/11).
Menurut Dade, jika benar ada penghentian kasus di tengah penyelidikan sama halnya Polda Malut ikut bermain politik di balik kasus tersebut. Apalagi proses perkembangan kasus lebih dulu diketahui terlapor dan disampaikan secara terbuka bahwa kasus tersebut akan dihentikan.
“Ini kesannya Polda bermain politik karena keterangan terlapor bersesuaian dengan apa yang disampaikan Kabid Humas sehari setelahnya,“ tegas Dade.
Terkait kasus ini, Dade menegaskan bahwa saat ini penyidik Polda Malut tidak memiliki alasan yang kuat untuk menghentikan (SP3) karena baru tahap penyelidikan. Kecuali jika kasusnya sudah ditingkatkan pada tahap penyidikan. Mestinya, lanjut Dade, Polda harus melakukan uji forensic untuk memastikan keaslian ijazah tersebut sehingga ada kesimpulannya.
“Tapi ini kan belum apa-apa kok dihentikan gimana. Ini aneh. Lebih aneh lagi Kabid Humas Polda berkomentar seperti itu,” kesalnya.
Dade meminta Polda Malut tidak menjadikan kasus ini untuk kepentingan lain yang dapat merugikan terlapor Usman Sidik, secara hukum. Polda harus mematuhi instruksi Kapolri Jendral Idham Azis, yang telah menerbitkan surat Telegram Rahasia (TR) bernomor ST/2544/VIII/RES.1.24./2020 tertanggal 31 Agustus 2020. Telegram itu berisi perintah kepada anggota Polri untuk menunda proses hukum para calon kepala daerah pada Pilkada serentak 2020. Instruksi Kapolri tersebut merupakan wujud dan komitmen Kapolri menegakkan netralitas Polri dalam pelaksanaan Pilkada serentak 2020. Telegram tersebut mengatur soal netralitas dan profesionalitas pelaksanaan pelayanan masyarakat, khususnya di bidang penegakan hukum untuk menghindari conflict of Interest serta menghindari pemanfaatan kepentingan politik oleh kelompok tertentu.
Aturan penundaan proses hukum kepada peserta pilkada itu juga mengacu pada UU Nomor 8 tahun 1981 tentang KUHAP, UU Nomor 2 tahun 2002 tentang Polri, UU Nomor 6 tahun 2020 tentang Penetapan Perppu Nomor 2 tahun 2020 tentang Perubahan Ketiga atas UU Nomor 1 Tahun 2015 tentang Penetapan Perppu Nomor 1 tahun 2014 tentang pemilihan gubernur, bupati, dan wali kota. Selain itu, PKPU Nomor 15 tahun 2019 tentang tahapan, program dan jadwal penyelenggaraan pemilihan gubernur dan wakil gubernur, bupati dan wakil bupati, dan atau wali kota dan wakil wali kota. (*)
