PENAMALUT.COM, TERNATE – Dinas Perindustrian dan Perdagangan (Disperindag) Kota Ternate diduga tidak menyetorkan pungutan retribusi pasar senilai 1,8 miliar rupiah pada tahun 2019.
Ini berdasarkan temuan Badan Pemeriksaan Keuangan (BPK) tahun 2019 dan 2020.
Menindaklanjuti temuan ini, Kepala Kejaksaan Negeri (Kajari) Ternate melalui seksi Perdata dan Tata Usaha Negara akan melakukan negosiasi terkait temuan BPK tahun 2019 dan 2020 tentang pendpatan retribusi pasar grosir dan pertokoan serta retribusi tera ulang yang tidak disetorkan ke kas daerah.
Kepala Seksi Datun Kejari Ternate, Safri Abdul Muin menjelaskan, ada beberapa item pungutan retribusi pasar grosir dan pertokoan yang tidak disetorkan ke kas daerah, sehingga menjadi temuan.
“Ada booking fee yang tidak memiliki dasar pemungutan. Penerimaan retribusi pelayanan pasar grosir dan pertokoaan yang tersebar di 58 ruko, kios, dan lapak telah dipungut, namun tidak dilaporkan dan tidak disetor ke kas daerah,” katanya kepada wartawan, Rabu (28/7).
Selain itu, lanjut mantan Kasi Intel Kejari Tidore ini, terdapat juga pungutan retribusi pasar grosir dan pertokoaan melebihi kontrak, tetapi tidak disetor juga ke kas daerah.
Safri menguraikan, pungutan booking fee atau tanda jadi merupakan uang yang dipungut dari wajib retribusi tidak diatur dalam peraturan-peraturan tentang retribusi pelayanan pasar maupun peraturan terkait lainnya.
Hal ini, kata dia, jelas bertentangan dengan Peraturan Pemerintah (PP) Nomor 58 tahun 2005 tentang pengelolaan keuangan daerah yang kemudian diganti dengan PP Nomor 12 tahun 2019 tentang pengelolaan keuangan daerah.
“Di mana pasal 57 ayat 2 PP Nomor 58 tahun 2005 dan pasal 137 ayat 1 PP Nomor 12 tahun 2019 menyatakan bahwa bendahara penerima wajib menyetor seluruh penerimaannya ke rekening kas umum daerah selambat lambatnya dalam waktu satu hari kerja,” jelas dosen Fakultas Hukum Universitas Muhammadiyah Maluku Utara (UMMU) itu.
Ia bilang, langkah ini diambil karena ada MoU antara Kejari Ternate dan Pemkot Ternate. Turunan dari MoU itu kemudian diterimanya Surat Kuasa Khusus (SKK).
“Jadi kita akan negosiasi terkait temuan ini BPK ini,” tutup Safri yang juga mantan Kasi Pengelolaan BB Kejari Konawe Selatan ini. (red)
