Kemenkumham Malut Jangan Tertutup Terkait Investigasi di Lapas Labuha

PENAMALUT.COM, TERNATE – Akademisi Universitas Khairun (Unkhair) Ternate, Abdul Kadir Bubu, mendesak Kantor Wilayah (Kanwil) Kementerian Hukum dan Hak Asasi Manusia (Kemenkumham) Maluku Utara segera memberikan sanksi tegas kepada Kalapas Labuha atas dugaan keluar masuknya satu Narapidana hingga menghamili pacarnya di luar jeruji besi.

Abdul Kadir Bubu mengatakan, pengakuan Plt Kalapas Labuhan,Tahir Rumadaul bahwa ia memberikan izin kepada Napi yang bersangkutan untuk keluar sudah sangat jelas. Bahkan tanpa pengakuan Kalapas juga sudah terbukti bahwa tidak mungkin Napi tersebut tidak berhubungan langsung dengan kekasihnya di luar tahanan hingga menyebabkan kekasihnya hamil.

“Keadaan itu mengonfirmsi bahwa dia (Napi) ternyata berkeliaran di luar Lapas. Apakah dia keluar atas izin Kalapas atau petugas Lapas, itu soal lain. Yang pasti dia di luar Lapas,” ujar Dade sapaan akrab Abdul Kadir Bubu saat ditemui wartwan, Senin (19/9) malam.

Artinya, lanjut Dade, ini ada kesengajaan dan kelalaian besar yang dilakukan oleh pihak Lapas Labuha untuk membiarkan atau mengizinkan Napi itu keluar dan berkeliaran, sehingga berhubungan dengan kekasihnya di luar.

Kehamilan perempuan itu menurut Dade, mengonfirmasi atau membuktikan bahwa ada kelalain besar atau kesengajaan membiarkan Napi ini keluar.

“Jadi pengakuan Kalapas itu sudah cukup, sehingha Kanwil Kemenkumham Malut tidak perlu turun ke Lapas Labuha. Karena jelas ada kesengajaan dilakukan oleh Kalapas yang membiarkan atau mengizinkan Napi ini keluar dari Lapas,” tandas Dosen Fakultas Hukum itu.

Semestinya, kata dia, ini tidak terjadi sebagaimana protap Lapas, sehingga Napi bersangkutan tidak melakukan hubungan badan dengan pasangannya dan hamil di luar Lapas. Sehingga itu, yang mesti dilakukan oleh Kanwil Kemenkumham Maluku Utara adalah memberikan hukuman kepada Kalapas Labuha.

Sebab orang seperti itu tidak boleh lagi diberikan kesempatan untuk memimpin lembaga tersebut. Jika terus dibiarkan, maka perilaku terus berulang.

“Ini mungkin hanya satu yang tercium dan terbukti, bisa jadi merupakan puncak dari gunung es selama ini.  Praktik-praktik seperti itu terjadi sengaja dilakukan atau membiarkan transaksi dengan para Napi dan dibiarkan keluar. Itu praktik biasa yang sering kita dengar dari para Napi,” kesalnya.

Kandidat Doktor UII ini juga mendesak kepada Kanwil Kemenkumham Malut segera menyampaikan hasil secara terbuka kepada publik dari pemeriksaan, penelusuran, investigasi atau pencari fakta yang telah dilakukan di Lapas Labuha. Sebab apa yang dilakukan Napi itu telah diketahui publik. Kemudian sanksi tegas diberikan kepada Kalapas dan jajaran yang telah melakukan kerja sama membiarkan atau memberi izin Napi ini keluar.

“Ini penting orang dihukum itu menjalani hukuman, bukan begitu caranya,” tukasnya.

Sebelumnya, Pelaksana Tugas (Plt) Kepala Lapas Labuha, Tahir Rumadaul mengaku, Napi yang berinisial AM alias Arifin (40) itu keluar dari Lapas karena ingin menjenguk anaknya yang sedang sakit di rumah.

Sedangkan ketika ada informasi bahwa AM bertemu kekasih dan menghamilinya di luar jeruji besi, itu di luar dari dugaan pihaknya. Izin yang diberikan kepada Napi tersebut bukan untuk bertemu kekasihnya, apalagi sampai ada dugaan menghamilinya. Napi tersebut juga baru pertama diberi izin keluar.

AM merupakan pelaku kasus pencabulan yang divonis 18 tahun penjara dan sudah dijalaninya beberapa tahun. AM akan bebas pada tahun 2024 mendatang. Ia juga mendapat remisi sebanyak 2 tahun 8 bulan dan 15 hari. (gon/ask)
