PENAMALUT.COM, TERNATE – Ketidakhadiran Wali Kota Ternate M. Tauhid Soleman dalam sidang dugaan korupsi anggaran kegiatan Hari Olahraga Nasional (Haornas) pada persidangan pekan kemarin disesalkan banyak pihak.
Direktur Yayasan Lembaga Bantuan Hukum (YLBH) Provinsi Maluku Utara, M.Bahtiar Husni menuturkan, setiap panggilan baik pada tahap penyidikan maupun pada tahap persidangan sebagai warga negara yang baik maka wajib hukumnya datang dan memberikan keterangan terkait dengan perkara yang disidangkan.
Oleh sebab itu, ketidakhadiran orang nomor satu di jajaran Pemkot Ternate ini sangat disesalkan. Seharusnya ketidakhadirannya harus disertai alasan.
“Beliau (wali kota) tidak hadir ini mencerminkan bahwa tidak taat hukum. Ini yang harus dilihat ya, bahwa setiap warga negara wajib untuk tunduk dan patut, karena tidak memandang jabatan maupun status,” ujarnya kepada wartawan Nuansa Media Grup (NMG), Senin (27/2).
Untuk itu, setiap pemanggilan dia wajib hadir di persidangan. Jika tidak hadir, maka bisa dihadirkan dengan paksa. Panggilan paksa dapat dilakukan pada tahap penyidikan maupun pada proses persidangan. Panggil dan jemput paksa hanya dapat dilakukan setelah pemanggilan secara sah dan patut telah dilakukan, namun bersangkutan tidak hadir.
“Dalam Pasal 112 ayat (2) KUHAP dijelaskan orang yang dipanggil wajib datang kepada penyidik dan jika ia tidak datang, maka penyidik dapat memanggil sekali lagi dengan perintah kepada petugas untuk membawa kepadanya,” jelasnya.
Lanjut Bahtiar, majelis hakim menetapkan panggilan sekaligus perintah untuk membawa wali kota ketika panggilan kedua juga tidak hadir, karena keterangan wali kota dalam perkara Haornas itu sangat penting untuk pembuktian materil.
Sebab itu, sebagai warga Negara apalagi seorang wali kota harus memberikan contoh yang baik kepada warga.
“Ini contoh yang baik mentaati prosedur hukum yang ada. Jadi kami sangat berharap wali lota harus memberikan contoh yang baik dengan datang memberikan keterangan di persidangan agar perkaranya ini menjadi terangan benderang,” harapnya.
“Wali kota wajib memberikan contoh yang baik dengan cara memenuhi panggilan penyidik atau JPU untuk memberikan keterangan di persidangan, agar majelis hakim bisa mendapatkan gambaran hukum yang jelas agar tidak salah dalam mengambil keputusan. Sebab ini terkait nasib terdakwa di pengadilan dalam mengahadapi proses persidangan,” pungkasnya. (gon/ask)
