PENA – Aktivis HMI, Maruf Madjid mengingatkan kepada Wali Kota Ternate, M Tauhid Soleman agar tidak mengabaikan masalah pembelian lahan eks rumah dinas Gubernur Maluku Utara di Kelurahan Kalumpang, Ternate Tengah, senilai Rp 2,8 miliar.
Setidaknya, menurut Maruf, penyelesaian dugaan masalah pembelian lahan eks rumah dinas Gubernur itu menjadi prioritas Wali Kota dalam waktu cepat, sebelum terseret masuk ke proses hukum.
“Kalau sudah proses hukum, maka ini masalah besar. Jangan anggap remeh hal ini. Kalau memang masih sebatas administrasi, ya segera selesaikan. Tapi kalau masalah ini mengarah pada dugaan korupsi, itu sudah lain,” ujar alumni hukum Unkhair Ternate itu.
Lanjut Maruf, sah sah saja pada program 100 hari kerja, Wali Kota dan wakilnya memprioritaskan kegiatan lain. “Saya hanya menyarankan agar masalah pembelian lahan eks rumah dinas Gubernur itu pun diperhatikan, jangan sampai muncul masalah,” tambahnya menegaskan.
Sekadar diketahui, Pemkot Ternate melakukan pembayaran lahan eks rumah dinas Gubernur pada Februari 2018. Uang sebesar Rp 2,8 miliar ditransfer ke rekening pihak ketiga yakni Gerson Yapen yang mengaku sebagai pemilik lahan.
Padahal sebelumnya lahan tersebut digugat Gerson Yapen yang mengaku sebagai pemilik lahan. Hanya saja Gerson Yapen kalah. Tak sampai disitu, Gerson juga melakukan kasasi ke Mahkamah Agung (MK).
Dalam putusan kasasi Mahkamah Agung RI Nomor 191 K/Pdt/ 2013, atas gugatan pemilik lahan eks kediaman Gubernur Malut, sertifikat hak milik nomor 227 tahun 1972. Bahwa status pemilik lahan dikembalikan ke pemerintah, bukan milik perorang, termasuk Gerson Yapen.
Jika status lahan sudah dikembalikan ke Pemerintah, maka Pemkot Ternate tidak boleh membayar kepada Gerson Yapen yang bukan sebagai pemilik lahan sebagaimana putusan kasasi Mahkamah Agung RI, dan aset tersebut dikembalikan ke pemerintah.(*)
